These Terms & Conditions (“Terms”) govern your access to and use of the Speaklay website, platform, and services by students, teachers, and all users.

By accessing or using Speaklay, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

1. About Speaklay

Speaklay is an online learning marketplace that connects students with independent teachers for live lessons, courses, and educational services.
 

Speaklay provides the technology platform only and is not a party to the teacher-student agreement unless explicitly stated.

2. Eligibility

To use Speaklay, you must:

  • Be at least 13 years old (or have parental consent)

  • Provide accurate and up-to-date account information

  • Use the platform in compliance with applicable laws

3. User Accounts

  • Each user is responsible for their account and activity

  • Account sharing is not allowed

  • You must keep your login credentials secure

  • Speaklay may suspend or terminate accounts that violate these Terms

4. Roles on Speaklay

      a) Students

  • Students may:

  • Browse teacher profiles

  • Book lessons and courses

  • Communicate with teachers via the platform
    b) Teachers

  • Teachers:

  • Operate as independent contractors, not employees

  • Are responsible for lesson content, quality, and conduct

  • Must provide accurate profile and availability information

4. Roles on Speaklay

      a) Students

  • Students may:

  • Browse teacher profiles

  • Book lessons and courses

  • Communicate with teachers via the platform
    b) Teachers

  • Teachers:

  • Operate as independent contractors, not employees

  • Are responsible for lesson content, quality, and conduct

  • Must provide accurate profile and availability information

5. Lessons & Bookings

  • Lesson details, pricing, and policies are shown before booking

  • Teachers manage lesson structure, content, and delivery

  • Speaklay does not guarantee learning outcomes

6. Payments, Fees & Payouts

  • Payments are processed securely through third-party providers (e.g., Stripe)

  • Speaklay may charge a platform service fee

  • Teachers receive payouts according to the platform’s payout schedule

  • Speaklay does not store full payment card details

7. Cancellations & Refunds

  • Cancellation and refund policies may vary by teacher or lesson type

  • Missed lessons without notice may be non-refundable

  • Speaklay may review disputes to ensure fair use of the platform

8. Platform Conduct & Acceptable Use

All users agree not to:
 

  • Engage in harassment, abuse, or discrimination

  • Share harmful, misleading, or inappropriate content

  • Attempt to bypass platform payments or contact systems

  • Violate intellectual property rights

  • Use the platform for unlawful activities

9. Intellectual Property

  • Speaklay owns all platform branding, design, and technology

  • Teachers retain ownership of their own lesson materials

  • Users may not copy, reproduce, or distribute platform content without permission

10. Privacy & Data Protection

Your use of Speaklay is governed by our Privacy Policy, which explains how personal data is collected and used.

11. Third-Party Services

Speaklay may integrate third-party services (video tools, payments, analytics).
We are not responsible for third-party platforms or their policies.

12. Account Suspension & Termination

Speaklay may suspend or terminate any account if:

  • These Terms are violated

  • Fraudulent or abusive activity is detected

  • Required by law or platform security needs

13. Disclaimers

  • Services are provided “as is” and “as available”

  • Speaklay does not guarantee uninterrupted service

  • Teachers are solely responsible for lesson outcomes

14. Limitation of Liability

  • To the maximum extent permitted by law:

  • Speaklay is not liable for indirect or consequential damages

  • Speaklay is not responsible for teacher-student disputes

  • Users use the platform at their own risk

15. Governing Law

These Terms are governed by applicable laws based on Speaklay’s operating jurisdiction, without regard to conflict-of-law rules.

16. Changes to These Terms

Speaklay may update these Terms from time to time.
Continued use of the platform means acceptance of the updated Terms.
